Terms of Use

1. Scope and provider

These Terms govern the use of FilmJourney (the platform), operated by Come Alive Film & Audio Solutions e.U., Neustiftgasse 10/20, 1070 Vienna, Austria (we, us). FilmJourney presents independent arthouse films after their festival run. By creating an account or using the platform you accept these Terms.

2. Accounts

  • You must provide accurate information and keep your login details confidential.
  • You are responsible for activity under your account. Tell us promptly if you suspect misuse.
  • There are viewer accounts and filmmaker accounts. Only filmmaker accounts can submit films.
  • You must be at least 16 years old, or have the consent of a parent or guardian, to create an account.

3. Using the platform as a viewer

  • The platform and its content are for your personal, non-commercial use.
  • You may not copy, record, download, redistribute or publicly show films, or share access links or passwords with others.
  • You may not bypass technical protection measures or interfere with the operation of the platform.

When paid viewing is introduced, prices, payment methods, access periods and your cancellation and withdrawal rights will be shown before purchase and will form part of these Terms.

4. Submitting films as a filmmaker

  • You confirm that you hold all rights necessary to submit the film and to authorise us to present it on the platform, including music, footage and artwork, and that the film does not infringe the rights of third parties.
  • The information you provide must be accurate and complete.
  • Submitting a film does not guarantee publication. We decide at our discretion whether to publish a film and may reject or remove a submission, with or without a note.
  • Screener links and passwords are used only to review the submission and are not published.
  • By submitting, you grant us a non-exclusive licence to host, display and stream the film, and to use its poster, trailer, synopsis and other promotional material, on the platform and for its promotion, for as long as the film is listed. Commercial terms, including any revenue share, are agreed separately and in writing before the film is made available for paid viewing.
  • You can ask us at any time to remove your film. We will remove it within a reasonable period, subject to any rights already granted to viewers for content they have purchased.
  • You keep all ownership of your film and of your other intellectual property.

5. Content and intellectual property

The films and related materials belong to their respective rights holders. The platform design, texts and software belong to us or our licensors. Nothing in these Terms transfers ownership of any intellectual property.

6. Prohibited conduct

  • Submitting unlawful content or content you have no right to submit.
  • Attempting to access accounts, data or admin areas that are not yours.
  • Automated scraping or any use that disrupts the platform.

We may suspend or delete accounts that breach these Terms.

7. Availability and changes

We aim to keep the platform available but cannot guarantee uninterrupted operation. We may change, suspend or discontinue features, and we may update these Terms. Material changes will be announced on the platform, and continued use afterwards means you accept the updated Terms.

8. Liability

We are liable without limitation for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only for the breach of essential contractual obligations and only for foreseeable, typical damage. Mandatory consumer protection rights remain unaffected.

9. Governing law

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this applies only as far as it does not remove mandatory protection provided by the law of their country of residence.
